This Privacy Policy governs the manner in which TMSOFT, LLC (“TMSOFT,” “we,” “us,” or “our”) collects, uses, maintains, and discloses information collected from users (“User” or “you”) of our digital properties. This Policy applies to:
- TMSOFT – the tmsoft.com website including all subdomains
- Playapod – the Playapod mobile applications and associated playapod.com website
- Sleep Sounds — the Sleep Sounds mobile applications and associated websites sleepsounds.fm, sleepsounds.me, and sleepsounds.tv
- Generator Apps – the Noise Generator, Fan Generator, Tone Generator, and Binarual Beats Generator mobile applications
- Games – all games published under the TMSOFT brand including the games.tmsoft.com website
- All other software applications, mobile apps, and digital services published under the TMSOFT brand
All of the above are collectively referred to as the “Services.”
Notice Regarding Recording and Interception of Communications (California Invasion of Privacy Act)
TMSOFT, LLC provides this notice pursuant to the California Invasion of Privacy Act (“CIPA”), California Penal Code §§ 630–638, and related California privacy laws.
By using our Services, you expressly consent to the following:
- The use of cookies, pixel tags, SDKs, and similar technologies by TMSOFT and its third-party analytics partners to collect information about your interactions with our Services, as described in detail in this Policy.
- The potential interception, recording, or analysis of communications and behavioral data transmitted through or in connection with our Services by authorized third-party service providers acting on TMSOFT’s behalf, solely for the purposes described herein (e.g., analytics, app performance, fraud detection).
- The use of session-level analytics tools that may record clicks, taps, scrolls, page views, and similar interactions within our websites and applications for the purpose of improving user experience and product quality.
If you do not consent to these practices, please do not use our Services. California residents have additional rights described in the “California Privacy Rights” section below, including the right to opt out of certain data uses.
Information We Collect
Personal Identification Information
We may collect personal identification information from Users in a variety of ways, including when Users visit our Services, register an account, subscribe to a newsletter, make a purchase, or otherwise interact with our Services. This may include name, email address, and similar contact information, but only when voluntarily provided by the User. Users may generally visit our website anonymously. Refusal to supply personal information may limit access to certain features.
Non-Personal Identification Information
We automatically collect non-personal information when Users interact with our Services, including browser type, device type, operating system, internet service provider, IP address (which may be truncated or anonymized), referring URLs, and similar technical data. This data is used in aggregate to improve our Services and is not linked to individual identities.
Cookies and Similar Tracking Technologies
Our Services use cookies, pixel tags, mobile advertising identifiers, SDKs, and similar technologies (“Tracking Technologies”) to enhance user experience, deliver advertising, and measure performance. These include:
- First-party cookies set by TMSOFT to maintain session state, remember preferences, and facilitate opt-out signals.
- Third-party cookies and SDKs set by our advertising and analytics partners (see “Advertising and Third-Party Partners” below) that may collect information about your device and browsing behavior across websites and applications over time.
- Mobile advertising identifiers such as Apple’s Identifier for Advertisers (IDFA) or Google’s Advertising ID (GAID), which may be used to deliver targeted advertising within our mobile applications.
You may configure your browser to refuse cookies or alert you when cookies are being sent. Disabling cookies may impair certain functions of our Services.
Session Replay and Analytics Technologies
We may use session replay or behavioral analytics tools that record mouse movements, clicks, scrolls, keystrokes (excluding passwords and sensitive fields), and page navigation within our websites and applications. This data is used solely to improve product usability and is not shared for advertising purposes. By using our Services, you expressly consent to this recording as disclosed here and as required by CIPA and analogous state wiretapping statutes.
App-Specific Data — Playapod
For Playapod users, we store information about your podcast subscriptions, individual episodes, and listening progress to enable synchronization across your devices. We also collect anonymized statistics about which podcasts are most popular in order to generate our “Popular List.” This data is not linked to your personal identity. Playapod does not display advertising.
App-Specific Data — Generator Apps
The Generator Apps (Noise Generator, Fan Generator, Tone Generator, and Binaural Beats Generator) optionally allow users to create an account to back up application settings and custom presets to TMSOFT servers, enabling restoration of those settings across devices or after reinstalling the app. Account creation requires a valid email address. When you register a new account, you will receive a one-time email verification message to confirm your email address. Once your account is verified and active, you will receive a welcome email. Beyond these transactional emails, we will not use your email address for promotional or marketing purposes without your explicit opt-in consent. The Generator Apps display advertising as described in the “Advertising and Third-Party Partners” section below.
App-Specific Data — Analytics and Remote Configuration
All TMSOFT mobile applications use Firebase, a platform provided by Google LLC, for analytics and remote configuration. Note: The tmsoft.com website does not currently use Google Analytics or similar web analytics tools. Firebase Analytics collects information such as app sessions, in-app events, device type, operating system version, approximate geographic location, and mobile advertising identifiers. This data is used to understand how users interact with our apps and to improve the user experience. Firebase Remote Configuration is used to deliver feature flags and configuration updates to our apps without requiring an app update. Remote configuration does not collect personal information. Data collected through Firebase is transmitted to and stored by Google on servers in the United States. You may opt out of Firebase Analytics data collection by adjusting your device’s advertising settings (see the “Advertising and Third-Party Partners” section) or by disabling analytics in the app settings where available. How We Use Collected Information
TMSOFT uses collected information for the following purposes:
- To provide and improve our Services: We use aggregate usage data to understand how users interact with our products and to make product and content improvements.
- To personalize your experience: We may use information in the aggregate to understand how users as a group use our Services and resources.
- To communicate with you: Email addresses provided for order processing or account creation are used to send transactional communications, including order confirmations and support responses. If you opt in to our mailing list, you may also receive company news and product updates. Every marketing email includes a clear unsubscribe mechanism. We will honor unsubscribe requests promptly.
- To serve advertising: We and our third-party partners use Tracking Technologies to deliver advertisements, including interest-based or targeted advertising, within our mobile applications. Note that Playapod and the tmsoft.com website do not display advertising.
- To detect fraud and ensure security: We may use technical data to detect, investigate, and prevent fraudulent transactions and other illegal activity.
- To comply with legal obligations: We may process and retain data as required by applicable law.
How We Protect Your Information
We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encrypted data transmission (TLS/HTTPS), access controls, and secure data storage practices. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify affected users as required by applicable law.
Data Retention
We retain your personal information for as long as your account is active or as needed to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements. When you request deletion of your account and personal information, we will process your request within thirty (30) days, subject to any legal retention requirements. Aggregated, anonymized data may be retained indefinitely as it cannot be linked to any individual.
Sharing Your Personal Information
We do not sell, trade, or rent your personal identification information to third parties. We may share generic, aggregated demographic information—not linked to any personal identification information—with business partners, trusted affiliates, and advertisers for the purposes described above.
We may disclose personal information: (a) to comply with a legal obligation; (b) to protect and defend the rights or property of TMSOFT; (c) to prevent or investigate possible wrongdoing in connection with the Services; (d) to protect the personal safety of Users of the Services or the public; or (e) to protect against legal liability.
Business Transfers: In the event of a merger, acquisition, reorganization, or sale of all or a portion of our assets, your personal information may be transferred to the successor entity. We will notify users of any such transfer and any material changes to privacy practices by posting a notice on our website.
Advertising and Third-Party Partners
Advertisements appearing in our Services may be delivered by third-party advertising partners. These partners may use Tracking Technologies to collect non-personal information about Users to compile data and deliver targeted advertising. TMSOFT does not control these third parties’ privacy practices. Note: Playapod does not display advertising. All other TMSOFT mobile applications may display ads from the partners listed below.
California residents: TMSOFT’s use of third-party advertising SDKs and scripts on our websites and in our applications may constitute a “sale” or “sharing” of personal information under the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”). California residents have the right to opt out. See the “California Privacy Rights” section below.
By continuing to use our Services, you affirmatively consent to the use of these technologies by our advertising partners as described in this Policy. If you wish to withdraw consent, please use the opt-out mechanisms described in this Policy and in the “California Privacy Rights” section.

If you click on a third-party advertisement or link, you will be leaving TMSOFT’s Services, and any personal data you provide on third-party sites will be governed by their privacy policies, not this Policy.
The operating system on your mobile device may provide additional controls to limit advertising tracking. For example, you may use the “Limit Ad Tracking” setting on iOS devices or “Opt out of Ads Personalization” on Android devices.
California Privacy Rights (CCPA / CPRA)
This section applies solely to residents of the State of California and supplements the information contained in this Privacy Policy. TMSOFT adopts this notice to comply with the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA/CPRA”).
Categories of Personal Information We Collect
In the preceding 12 months, TMSOFT has collected the following categories of personal information from consumers: identifiers (e.g., name, email address, IP address, mobile advertising IDs); internet or other electronic network activity information (e.g., browsing behavior, search history, interactions with our Services); geolocation data (general location derived from IP address); and commercial information (e.g., records of products or services purchased).
Purposes for Collection
We collect and use personal information for the business and commercial purposes described in the “How We Use Collected Information” section above.
Sale or Sharing of Personal Information
TMSOFT does not sell your personal information in the traditional sense. However, our use of third-party advertising and analytics technologies may constitute a “sale” or “sharing” of personal information under the CCPA/CPRA (i.e., disclosure of personal information to third parties for cross-context behavioral advertising). California residents have the right to opt out of such sale or sharing.
Your California Privacy Rights
California residents have the following rights with respect to their personal information:
- Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, the business or commercial purposes for collecting or selling it, and the categories of third parties with whom we share it.
- Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions permitted by law.
- Right to Correct: You have the right to request that we correct inaccurate personal information we maintain about you.
- Right to Opt Out of Sale / Sharing: You have the right to opt out of the sale or sharing of your personal information. To exercise this right, email us at support@tmsoft.com with the subject line “California Opt-Out Request” or use the device-level advertising opt-out controls described in the “Advertising” section above.
- Right to Limit Use of Sensitive Personal Information: To the extent TMSOFT collects sensitive personal information as defined by the CPRA, you have the right to direct us to limit its use to those purposes authorized by law.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of any CCPA/CPRA rights. We will not deny you goods or services, charge you different prices, provide a different level of quality, or suggest you will receive different treatment because you exercised your rights.
How to Submit a Request
To exercise your rights described above, please contact us at: support@tmsoft.com. We will verify your identity prior to processing your request. We will respond to verifiable consumer requests within 45 days of receipt, with the possibility of a 45-day extension where reasonably necessary with prior notice.
Authorized Agents
You may designate an authorized agent to make a request on your behalf. We may require you to provide the authorized agent written permission and verify your identity directly.
Children’s Privacy
Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. If you believe we have collected personal information from a child under 13, please contact us at support@tmsoft.com.
Deleting Your Information
All mobile apps that provide for account creation can delete their associated accounts from within the mobile app settings. If you cannot access your account or need help with deleting your information please email support@tmsoft.com.
Governing Law
This Privacy Policy is governed by the laws of the State of Florida, without regard to its conflict of law provisions, consistent with our Terms of Use.
Changes to This Privacy Policy
TMSOFT, LLC reserves the right to update this Privacy Policy at any time. When we do, we will revise the “Last Updated” date at the top of this page and, where practicable, provide notice to Users (e.g., via email or a notice on our website). We encourage Users to review this page periodically for any changes. Your continued use of the Services following the posting of changes constitutes your acceptance of those changes.
